  5. Ensure the employer files H-1B petition on your behalf. (This involves submitting a Labor Condition Application (LCA) to the Department of Labor (DOL) and filing the Form I-129 with USCIS)
  6. Your employer has to enter your petition into the H-1B lottery. If selected, your petition will be processed. If approved, you can begin working in the U.S. once your visa is issued.

Duration of H-1B Visa Application
